Terms of Service

Crane Exam Prep is published by Devtech, LLC, an Ohio limited liability company ("Devtech," "we," "us"). These terms are a contract between you and Devtech, LLC — not between you and Apple Inc. or Google LLC. By creating an account or using Crane Exam Prep (the "app"), you agree to these terms. If you download the app from Apple's App Store or Google Play, you must also comply with that store's terms of service, and with any applicable third-party terms of agreement.

2. What Crane Exam Prep is

Crane Exam Prep is a study platform for crane operator certification prep: lessons, flash-card decks, practice tests, an exam simulator, reference tools, and a certification wallet.

3. What Crane Exam Prep is not — no affiliation

Crane Exam Prep is an independent study tool. We are not affiliated with, endorsed by, sponsored by, or acting on behalf of NCCCO/CCO, OECP, OSHA, or any certifying or regulatory body. NCCCO, CCO, and OECP are marks of their respective owners and are used only to describe which exams the material helps you prepare for. Passing practice tests here does not certify or qualify you to operate equipment. Our reference tools and calculators are training aids only — always follow the manufacturer's load charts, official standards, applicable law, and your employer's procedures on a real job site.

4. Assumption of risk

Crane and rigging operations are inherently dangerous. You acknowledge that Crane Exam Prep is educational material for written-exam preparation, not operational guidance, engineering advice, or a substitute for professional training, certification, supervision, or site-specific planning. Any decision to operate equipment, perform a lift, rig a load, or take any other action on a job site is made solely at your own risk and under your own judgment and your employer's direction.

5. Hold harmless and indemnification

To the fullest extent permitted by law, you agree to release, defend, indemnify, and hold harmless Devtech, LLC and its members, managers, officers, employees, contractors, and agents from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or inability to use Crane Exam Prep; (b) any act, omission, injury, death, or property damage occurring on a job site or in connection with the operation of equipment, regardless of whether you studied with or referenced Crane Exam Prep; (c) your violation of these terms; or (d) your violation of any law, regulation, standard, or third-party right.

6. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app for your own exam preparation. The app is licensed, not sold. All content — lessons, questions, explanations, images, software, and design — belongs to Devtech, LLC or its licensors and is protected by copyright and other laws. You may not copy, scrape, resell, redistribute, reverse-engineer, or use the content to build a competing product, and you may not share your account to give others access.

7. Purchases

Full access is a one-time purchase covering 12 months of access — not an auto-renewing subscription. Nothing renews on its own and there is nothing to cancel. Purchases made inside the iOS app are billed by Apple; purchases inside the Android app are billed by Google; web purchases are billed by our payment processor, Stripe. Purchase validation for the mobile stores is performed by RevenueCat acting as our service provider. Prices may change for future purchases; a change never shortens access you've already paid for.

8. Refund policy & pass guarantee

Study with Crane Exam Prep the way it's built to be used, and if you still don't pass your written certification exam, we'll refund your purchase in full. You qualify when all of the following are true: (1) before your exam date, your exam readiness score for the certification you tested for reached 90% or higher; (2) you mastered every deck in that certification's track; (3) you request the refund within 30 days of your exam date and include documentation of the result; and (4) you haven't already received a refund from us before. We verify your study record on our side. Approved refunds go back to your original payment method; purchases billed by Apple or Google are refunded through the store you bought from, under that store's refund process. To request a refund, use the Support form in the app or email info@devtechapplications.com.

9. Accounts

You must provide accurate information and keep your sign-in details to yourself. An account works on one device at a time — signing in on a new device signs the old one out. You can delete your account at any time in the app under Settings → Account → Delete account, or by emailing info@devtechapplications.com. We may suspend or terminate accounts that violate these terms or abuse the service.

10. Disclaimer of warranties

Crane Exam Prep is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the content is error-free, that the app will be uninterrupted, or that studying with Crane Exam Prep will result in a passing exam score or certification.

11. Limitation of liability

To the fullest extent permitted by law, Devtech, LLC will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, personal injury, death, or property damage, arising out of or related to the app, even if advised of the possibility. Our total aggregate liability for any claim arising out of these terms or the app will not exceed the amount you paid us in the twelve (12) months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you; in that case liability is limited to the maximum extent permitted.

12. Apple-specific terms (iOS app)

If you use the app on an Apple device: these terms are between you and Devtech only — Apple is not a party and is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price of the app; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claim by you or a third party relating to the app, including product-liability claims, claims that the app fails to conform to legal or regulatory requirements, and consumer-protection or similar claims. In the event of a third-party claim that the app infringes intellectual-property rights, Devtech — not Apple — is responsible for its investigation, defense, settlement, and discharge. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. government embargo or designated a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.

13. Google-specific terms (Android app)

If you obtained the app from Google Play, you also agree to the Google Play Terms of Service. Google is not a party to these terms, has no obligation to provide support for the app, and is not responsible for claims relating to it.

14. Governing law

These terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles. Any dispute arising out of these terms or the app will be brought exclusively in the state or federal courts located in Ohio, and you consent to their jurisdiction.

15. General

If any provision of these terms is found unenforceable, the rest remain in effect. These terms plus our Privacy Policy are the entire agreement between you and Devtech regarding the app. We may update these terms as the product evolves; continuing to use the app after an update means you accept the revised terms.
